I Already Have a Child Support Order, and I Know my Spouse Earns More Money. Can the Child Support Order be Increased?

Child support can be modified at any time as long as there is a change in circumstances. If one spouse loses his or her job, that spouse can request the court to modify child support upward or downward. If the payor or obligor spouse begins to earn more money, then the payee spouse can request the court to modify the amount of child upward. The key is that paperwork needs to be filed as soon as the party knows of the change in circumstances. The court will only change the order back to the date of filing the request to change the order.
